Procedure for the safe acquisition of property in Paros (Greece)

Every buyer should get in contact with a local lawyer, who will provide all necessary legal advice concerning the real estate transfer.

The buyer’s lawyer must conduct a search at the Registry of Mortgages for legal relationships in connection with the specific property over a period of at least 20 years. The lawyer must then make sure that the property is free of mortgages or prenotations of mortgage and free of claims (debts, confiscations etc.). Then in cooperation with a civil engineer or architect, the lawyer has to examine in case of construction works on the property, if they are based on a lawful building permission. Or if the property is only a plot of land, it should be examined if it can be built according to building laws and regulations.

The buyer’s lawyer should also apply for the acquisition of a Tax Registration Number at the local Tax Authorities, in order to be able to proceed to the purchase.

Very important for every buyer, who has not an income in Greece, is to ask his / her lawyer about the procedure of the transfer of purchase’s money.

In Greece both the purchase and transfer contracts require notarization. The purchase contract, in order to be valid, has to be signed before a Notary Public in presence of lawyers.

The notarized contract of the transferred property can be effective only if it is registered in the Registry of Mortgages or the Land Registry.

If it is not possible for each contracting party to be here on the island on the day of signing the contract, you can give authority of representation to another person by signing a Power of Attorney before a Notary Public. Foreign purchasers can sign proxies whether before a notary public in their country, which have to be vested with the “Apostille” form, in order to be recognized in Greece, or before a Greek consular official in the Greek Consulate.
